This week’s regulatory news finds a pair of new NPRMs as well as minor administrative actions from various agencies. Meanwhile, here’s the latest:
U.S. DOT
The department proposes to revise its drug testing procedures rule, which became effective on June 1, 2023, to provide interim provisions to require the conduct of directly observed urine tests in situations where oral fluid tests are currently required, but oral fluid testing is not yet available. If adopted, presumably this change would apply across the various modal substance abuse test regimes. Comments must be received on or before January 8, 2025. See the NPRM here.

FMCSA
In a new proposed rule, the agency proposed to amend the Federal Motor Carrier Safety Regulations (FMCSRs) to allow States to waive the hazardous materials (HM) endorsement requirement for holders of Class A commercial driver’s licenses (CDL) who transport no more than 1,000 gallons of aviation grade jet fuel in support of seasonal agricultural operations. Comments must be received on or before February 3, 2025. See the NPRM here.
