DG Digest: Federal Agencies Release Semi-Annual Regulatory Agendas, PHMSA Announces $41M in Grants to Support First Responders

The third week in August found regulatory activity picking up a little—perhaps it means folks are beginning to return from all those summer vacations as the season begins to wind down towards Labor Day. If you haven’t had your summer fun yet, don’t dawdle, school and the autumn aren’t terribly far way, and it’s a long wait for next June! Here’s the latest news:

PHMSA

The agency announced that it is awarding over $41 million in grants to states, territories, tribes, unions, and non-profits to support first responders and help enhance pipeline and hazardous materials safety programs at the community level for 11 different safety programs. This includes a more than 50 percent increase in funding for a grant to firefighters that will aim to double hazmat training for firefighters. See complete details here:

Transport Canada

The Ministry published a “Basic Competency Checklist for transporting dangerous goods.” The checklist does not introduce new regulations, but instead consolidates the required steps and competencies required to ship DG safely into one easily used document. Find out full information here.

CPSC

The U.S. Consumer Product Safety Commission published an NPRM addressing the risk of injury and death associated with children ingesting button cell or coin cell batteries obtained from toys by adding performance and labeling requirements for battery-operated toys containing such batteries. EPA

The agency is holding a three-day meeting of its electronic hazardous manifest advisory committee. The meeting begins September 17th. For details and how to participate, see the notice.

FMCSA

The agency will be reviewing its existing guidance documents to evaluate their continued necessity and determine whether they should be updated or eliminated. As part of this review, it invites the public to identify and provide input on existing guidance documents that are good candidates for revision or rescission. Comments should be received on or before September 12, 2024. Find full details here.

The agency also published a survey that allows for stakeholders to provide feedback to FMCSA on its service delivery to them. So, this would be a chance for affected industries to offer their thoughts. Find it here.

OSHA

The agency published an ICR renewal related to its Ionizing Radiation Standard, which is a rule related to safe control of the transmission of energy via things like radio and radar transmitters. See the ICR here.

A second ICR deals with the Methylene Chloride Standard. This chemical is common in industrial use. See the ICR here.

Yet a third ICR deals with truck mounted aerials lifts and work platforms. Find this ICR issuance here.

The agency announced that its National Advisory Committee on Occupational Safety and Health (NACOSH) will meet September 9, 2024, by teleconference and WebEx. See here for details on how to participate.
