Even as many workplaces begin to see open docks and other work areas for the summer, wildfire smoke has become a prevalent concern. Be sure that if your site is located in an area that is affected by such smoke, that you have a safety plan in place to minimize the impacts and protect your employees, especially those whose work takes them outdoors. Here’s the week’s regulatory news:
FMCSA
The agency is renewing an ICR titled, ‘‘Hazardous Materials Safety Permits.’’ This ICR requires companies holding safety permits to develop communication plans that allow for the periodic tracking of hazardous materials shipments. A record of the communications that includes the time of the call and location of the shipment may be kept by either the driver (e.g., recorded in the logbook) or the company. These records must be kept, either physically or electronically, for at least 6 months at the company’s principal place of business or readily available to the employees at the principal place of business.

Transport Canada
The Ministry has compiled a helpful list of current subjects that are presently under consideration, in comment phases, or otherwise are open dockets dealing with DG issues. Most of the items are presented with links to further information dealing with the specifics.

EPA
The agency is finalizing new and amended requirements concerning the assertion and treatment of confidential business information (CBI) claims for information reported to or otherwise obtained by EPA under the Toxic Substances Control Act (TSCA). This final rule is effective on August 7, 2023.

CPSC
The Commission is offering a further comment period for its proposed rule that would further direct reductions in the carbon monoxide emission levels from portable fossil-fueled generators. Such generators are common in industrial applications and can present a hazard in enclosed or poorly ventilated spaces.
