2013 Year-end Compliance Highlights (Part 2 of 3)

On Friday, December 6th, Labelmaster published the first in our three part series on 2013 Year-end Compliance Highlights that will continue to have an impact on workplace and transportation practices well into 2014. In the second installment, we highlight PHMSA DOT Final Rule.

October 31st and corrected editorial errors and amended specific requirements
in response to administrative appeals.

Noteworthy are the following:

    • 49 CFR § 172.316 Revisions were made to clarify the reclassification to ORM–D AIR is no longer authorized as of January 1, 2013.  PHMSA also explains that the ORM-D designation may be used domestically until December 31, 2020, when shipping ORM-D material as defined in § 173.144, that is packaged in accordance with § 173.63(b), 173.150 through 173.156, and 173.306.
    • 49 CFR 172.315 This section of the DOT hazardous material shipping regulations stipulates the requirements applicable to marking packages of limited quantity material.  In the January 7, 2013 final rule (HM–215K), PHMSA stated their intent to authorize continued use of the alternative limited quantity marking (i.e., square-on-point and Identification Number) prescribed in § 172.315(d), in effect on October 1, 2010, until December 31, 2015.  An incorrect date was published in the regulations.  With this final ruling, PHMSA authorized use of the alternative limited quantity marking prescribed in § 172.315(d) until December 31, 2015.
    • 49 CFR 172.101 A variety of changes were made to the Hazardous
      Materials Table.
