The last official week of the summer season was typical from a regulatory standpoint; a little of this, a little of that. Hopefully, everyone is ready for the fall and its attendant change in the weather and the nature of many activities. PHMSA
On July 5, 2023, the agency published an advance notice of proposed rulemaking, titled ‘‘Hazardous Materials: Modernizing Regulations to Improve Safety and Efficiency (HM– 265A),’’ seeking comment of 46 topics related to modernizing the hazardous materials regulations to increase efficiency while maintaining and improving safety. PHMSA is extending the comment period for the HM–265A notice for an additional 60 days. Comments to the HM–265A notice will now be due by December 4, 2023.

FMCSA
The agency renewed an ICR dealing with CMV maintenance recordkeeping. Such recordkeeping is a required action for many operators.

CPSC
While not directly hazmat related per se, the Commission did publish a direct final rule governing the safety of coin and button cell batteries in relation to their use by the public and particularly in reference to the danger they may represent if mishandled by children. The rule is effective October 23rd unless a significant adverse comment is received, in which case an analogous proposed rule was also published that will serve as a starting point for rulemaking.
