Posts Proposed E-Manifest Fee Schedule Framework: The US EPA posted a proposed rule in the Federal Register on July 29, 2016, creating a framework for establishing a user fee schedule for its electronic hazardous waste manifest tracking and record keeping system (E-Manifest system).  In addition, this rulemaking also includes minor amendments to the E-Manifest regulations established on February 7, 2014.

The E-Manifest System was originally established as an alternative method to track hazardous waste shipments from generators the treatment, storage and disposal facilities. Comments must be received on or before September 26, 2016. The EPA has established a dedicated website portal for viewing the proposed rule and submitting comments that can be viewed here.

PHMSA: 

Posts Proposed Expanded Oil Spill Response Plans for Railroads: On July 29, 2016, PHMSA posted a proposed rule in the Federal Register that will expand the guidelines for comprehensive oil spill response plans (OSRPs) required by railroads transporting high hazard flammable trains. The proposed rule also establishes ATSM standard D7900 as an alternative test for determining the initial boiling point for flammable liquids.

PHMSA, in cooperation with the Federal Railroad Administration, continues to evaluate the regulations pertaining to the transport of crude oil by rail as the volume of crude oil transported by rail continues to escalate.
