DG Digest: PHMSA special permits announced and U.N. GHS 8th Revision now available for download

Mid-October finds the regulatory scene continuing to be fairly active as the season advances.  The leaves are falling; be sure to keep your workplace’s sidewalks and other walkways clear to avoid leaves hiding cracks, bumps, or other imperfections that could pose a trip hazard for employees and visitors.  Here’s all the latest news:

PHMSA

The agency issued a new set of special permit actions.  They cover the usual range of topics, with a focus on cylinders, batteries, and various portable tanks:

PHMSA also issued a notice to clarify and request comments on the Approvals Program procedures for companies to request a modification to an explosives classification approval to reflect a merger, acquisition, or change in name or legal status. Interested persons are invited to submit comments on or before January 6, 2020. Here’s your access

In an interesting Letter of Interpretation (LOI), the agency published clarifying guidance on the use of substitute tapes on regulated packages.  The guidance appears to significantly limit such substitutions. See the letter here

OSHA

In a new ICR, OSHA requests information, comments, and documents that would assist the agency in determining whether to adopt a new online delivery model for OSHA’s Outreach Training Program. The OSHA Outreach Training Program is a hazard awareness training program that educates participants on the recognition, abatement, and prevention of job-related hazards in the construction, general, and maritime industries. OSHA plans to use the information collected from this request to determine whether the new model would address issues associated with the existing model. If the new model were implemented, the agency would develop policies and procedures for the online Outreach Training Program courses to ensure that online providers meet OSHA’s expectations for program quality and consistency. FMCSA

The agency has extended the comment period for its August 22, 2019, notice of proposed rulemaking (NPRM) to amend its rules concerning the Agency’s financial assistance programs. FMCSA received a request for an extension to the comment period from the Commercial Vehicle Safety Alliance (CVSA). The comment period for the NPRM published August 22, 2019, at 84 FR 44162, is extended to October 21, 2019. See further information here

U.N. GHS

The 8th Revision of the U.N. GHS is now available for download in both English and French.  The new revision includes a variety of changes, including classification for some gases as well as sundry test protocols and other minor changes. Here’s your access
